Terms of Service

Last updated October 2026. The deal between us, without the fog.

1. The agreement

These terms are between you (or the business you represent) and LEGAL ENTITY NAME, registered in COUNTRY, which operates WayChat. By creating an account or installing the widget you accept them. If you are accepting on behalf of a company, you confirm you are allowed to bind it.

2. What the service does

WayChat provides an AI chat and voice agent you embed on your website. It reads pages you point it at, answers your visitors, captures leads, can take payments through your own payment provider, and can book appointments into the slots you configure.

3. Your account

  • Give us accurate details and keep them current.
  • Keep your password to yourself. Anything done through your account is treated as done by you.
  • Tell us promptly if you think someone else has got in.
  • One account covers one business. Running several websites or client sites needs a plan that covers them — talk to us.

4. Free trial and billing

  • New accounts get a 7-day free trial with full access. No credit card needed to start.
  • After the trial the subscription is $29 per month, billed monthly in advance, until you cancel.
  • Prices are in US dollars and exclude any tax that applies where you are.
  • You can cancel at any time from your dashboard. See the refund policy for what happens to the rest of the period.
  • We may change the price with at least 30 days’ notice by email. If you do not accept it, cancel before the change takes effect.
  • If a payment fails we may suspend the service after telling you and giving you a chance to fix it.

5. What you are responsible for

This section matters more than the rest, so read it properly.

  • The content the agent learns from. You confirm you own, or are allowed to use, the pages and material you point it at.
  • What the agent says on your site. It answers from your content, and AI can be wrong. Review its answers, set your Q&A, and check anything that carries legal, medical, financial or safety weight before you rely on it. You are responsible for what your visitors are told.
  • Telling your visitors. You must disclose that an AI agent handles the chat, publish your own privacy policy, and obtain whatever consent your local law requires.
  • Prices, stock and availability. If your site is wrong, the agent will be too.
  • Your payment provider relationship. Money from your customers goes to your own account under your agreement with that provider. We are not a party to those transactions and not responsible for them.
  • Fulfilling what you sell. Orders and bookings taken in the chat are yours to honour.

6. Acceptable use

Do not use WayChat to:

  • Break the law, or help anyone else to
  • Impersonate a person or organisation, or pass the agent off as a human when asked directly
  • Give medical, legal or financial advice that a qualified person should be giving
  • Harvest personal data without a lawful basis, or send unsolicited bulk messages
  • Publish or generate content that is abusive, hateful, deceptive or sexually exploitative
  • Probe, overload or reverse-engineer the service, or resell it as your own without a written agreement

We may suspend an account that breaks these, and will tell you why.

7. Who owns what

  • Yours: your website content, your branding, your conversations, your leads, your customer data. We claim no ownership and will export it on request.
  • Ours: the WayChat software, interface, documentation and brand. Using the service does not transfer any of it to you.
  • Feedback you send us we may use to improve the product, with no obligation to you.

8. Third-party services

The agent relies on third-party AI, voice, hosting, email and payment providers. Their outages, changes and policies are outside our control. We will not knowingly keep using a provider we consider unsafe for your data.

9. Availability

We work to keep the service up and running, but we do not promise uninterrupted availability, and there is no service level agreement on the standard plan. We may take the service down for maintenance, and will give notice where we reasonably can.

10. Disclaimer

The service is provided “as is”. To the extent the law allows, we make no warranty that it will be error-free, that the agent’s answers will always be accurate, or that it will fit a particular purpose. AI output is generated text, not professional advice.

11. Limitation of liability

To the extent the law allows, neither side is liable to the other for indirect, incidental or consequential loss, lost profit, lost revenue, lost data or lost business. Our total liability for any claim is limited to the fees you paid us in the 12 months before the claim arose.

Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.

12. Indemnity

You agree to cover us against claims arising from your content, from what your agent told your visitors, or from your breach of these terms.

13. Ending the agreement

  • You can cancel at any time from your dashboard.
  • We may suspend or close an account that breaches these terms, or where we are required to by law.
  • On closure your widget stops answering. You can export your data for 30 days, after which we delete it per the privacy policy.

14. Changes to these terms

We may update these terms. Material changes are emailed to account holders at least 30 days before they take effect. Continuing to use the service after that means you accept them.

15. Governing law

These terms are governed by the laws of JURISDICTION, and the courts of JURISDICTION have exclusive jurisdiction over any dispute.
